Once again the 9th Circuit Appeals Court has failed the American people. It struck down the key component of the Arizona Immigration Law that requires people who register to vote to provide proof of citizenship. The ruling by a three-judge panel ruled that the law was inconsistent to the Voter Registration Act that does not require individuals to provide proof of identification to register to vote.
The ruling did leave in place a requirement for proof of identification when casting a ballot. The ruling contradicted a previous ruling by the same court that said Proposition 200 did not violate the Voter Registration Act. Chief Judge, Alex Kozinski wrote a dissent saying the ruling ignored precedent and was flat wrong on its legal analysis. The ruling almost appeared to be bought or some special favor was promised to the judges for their closed-eye approach to the law.
Gov. Jan Brewer issued a statement jointly with the Arizona Secretary of State saying the decision was an “outrange and a slap in the face to all Arizonans who care about the integrity of their elections.”
The attorney’s for the civil rights groups that brought the lawsuit said that the decision would enable many poor people that do not possess a driver’s license or birth certificate will be able to vote. The lack of a birth certificate is a concern. That should send a red flag that they may not be legal citizens and without a birth certificate they would not be eligible for many benefits from the government.
Retired Supreme Court Justice Sandra Day O’Connor joined the court panel in hearing the case as a temporary appeals court judge. Appeals Court Judge Sandra S. Ikuta joined O’Connor in stating that the federal voter registration law laid out special requirements that could not be made more onerous by a state. Therefore requiring identification for registration contradicted the existing law.
The Democratic views on gathering voters from the illegal alien pool are jeopardizing the stability and safety of our country. It was never so important as it is now with the violence across the border with the drug traffickers that have free reign to come and go in the United States as they please. Many of the Mexican drug cartels are being trained by terrorist organizations. Those terrorists also have the ability to come and go as they please across the border bring with them unknown people and possible weapons to harm Americans.
