The Judge presiding over the Lindsay Lohan case issued a bench warrant for her arrest Monday afternoon after the actress tested positive for cocaine on two recent court-ordered drug tests. While the warrant was issued for her arrest , she won’t be taken into custody until her hearing Friday, according to TMZ and People Magazine. Her arrest will either send the actress back to jail immediately for 30 days or back to rehab for violating her probation.
Lindsay admitted over the weekend through her Twitter account that she had failed her drug tests and was prepared to face Judge Fox and any consequences that resulted from her use of illegal drugs since her release from jail and three week stay in a drug rehab center. Lohan tweeted to her fans, “Regrettably, I did in fact fail my most recent drug test. Substance abuse is a disease, which unfortunately doesn’t go away over night. I am working hard to overcome it.”
When Lindsay Lohan was released from a rehab center late last month the Judge threatened her with the 30 day jail sentence if she failed another drug or alcohol test or did anything that violated her parole. She spent 13 days in jail and three weeks in rehab for a probation violation stemming from a 2007 arrest for drunk driving.
In the hearing Friday the Judge will determine Lohan’s fate and whether she will go straight to jail or back to rehab. Her recent release from rehab was based on reports from counselors at UCLA Medical Center who stated the 24-year-old actress was not a drug addict or alcoholic, and was not a danger to herself or others if released back to her old lifestyle.
Also on Monday Lindsay quietly ended her $100 million dollar lawsuit against E-Trade for a commercial that aired earlier this year she claimed was based on her and slandered her by claiming she had a drinking problem when one baby asked another if he was with “that milkaholic Lindsay.”
While many have already abandoned Lindsay Lohan in Hollywood, she still seems to have a strong supporter in Director Chris Hanley. Hanley has cast Lindsay in the new Linda Lovelace biopic Inferno that is set to start filming in November, saying that while he made it clear to Lohan at the start of the project he didn’t want her doing drugs or alcohol during filming, he still believes in her natural talent as an actress. Calling the recent disclosure of two positive drug tests a U-Turn for their film start date, Hanley is standing by Lindsay unless he can no longer keep her in the film due to legal reasons.
