After more than a year’s worth of back-and-forth negotiating, it appears that a resolution to a December 2008 accident involving a Royal Oak Department of Public Services dump truck is near. The City Commission of Royal Oak is expected to approve an out-of-court settlement on October 18. The settlement will award the injured driver, Angela Cooper, $140,000.
According to public records, Cooper was hit by a DPS dump truck as it changed lanes on Main Street near Harrison Avenue. Due to the accident, Cooper suffered from neck injuries; she had surgery to fuse two vertebras together shortly after the incident occurred.
Cooper filed a lawsuit; Oakland County Circuit Court decided that the city was liable. The case was due to go to trial in September of 2010, when it was sent to mediation instead. An evaluation panel recommended an award of $175,000 to Cooper; both parties rejected the recommendation, though. In turn, a facilitator recommended the $140,000 award.
