Many paralegals chose to be evolved with the family court system. The family court is the largest areas of paralegal employments; it includes divorce, legal separations custody, visitation paternity and adoption. With all these issues it becomes apparent that paralegals play a huge rule in these types of cases. With all the duties that are given to the paralegal it is up to the governing attorney to make sure everything is correct and signed for filing with the court.
Paralegals in this field may have to interview the client. This interview may be to find all the relative information to draft a motion or response to a motion. It may be to collect financial information or to compile a complete list of assets. It can be to gather information that the attorney requested or for an intake of the initial facts of the case for the attorney to review. The paralegals job in this case is to collect information not give the client any legal information regarding their case.
Paralegals will also be required to draft discovery requests and responses to motions. They will have to obtain information regarding assets that the other person is trying to hide or your client does not know about. Drafting motions and petitions are more of the legal paperwork that may be assigned by the governing attorney. As well as keeping up with and scheduling all court dates. This includes making sure the client is aware of all appointments.
The paralegal, working along side the attorney and the client will prepare the client and case for hearing, mediation or trial. They are also going to be the relay between the attorney and the client. They are going to forward questions for or from the attorney, making sure they never answer any legal question for the client. The paralegal will most defiantly be in constant content with the client regarding the case information and scheduling.
To be a leading paralegal it is important that you are able to calculate child support, create exhibits and be able to provide the attorney with detailed information regarding each and every case that is assigned to them. These paralegals should review case law and be on top of any case law changes that pertain to their field. Not only reading these changes but having them on file to refer to latter is very important. It’s also important to know have a list of people that may be needed during a divorce. This includes a property appraiser or maybe an antiques appraiser as you never know what you may need in any case.
So the role of paralegal in a divorce setting is a very busy person. Any and all of the above may be assigned by the governing attorney as well as many other things that may come up in the process of the court case. Paralegal are a vital asset in any case and can be a driving force behind any case.
