Lindsay Lohan has been ordered into custody today (September 24) and will be held without bail after failing a recent drug test that stems from her DUI probation. While Lohan was able to be released twice before experts have stated that she can’t be let out early this time.

According to Los Angeles Criminal Defense Attorney Mark Geragos who spoke with Pop Tarts, “This is becoming an increasingly common practice among judges in L.A – if he had sentenced her to a particular time such as 60 or 90 days the sheriff would have kicked her out after a few days due to prison overcrowding, but because he didn’t sentence her to a particular time without bail she has to stay in.”
Judge Elden Fox of Los Angeles Superior Court ordered that Lohan remain in custody until October 22 when her next hearing will be held. It’s a possibility that the troubled actress may be sentenced to more time in jail or ordered into rehab at that juncture.
Steve Whitmore, a spokesman for Los Angeles’ Sheriff’s office stated that Lohan can’t be released early simply because today’s ruling for not a jail sentence. “She’s being held by court order until her hearing on Oct. 22. She will be held in the same conditions as her last stay, in a keep-away unit.”
Whitmore also stated that Lohan is “very cooperative, very demure, very quiet. Once again she’s doing everything that is asked of her. Last time she did very well and so far, so good this time.”
By contrast, at her last appearance in court Lohan was very emotional and had the words “f— you” written on one of her middle fingers. The words were thought to be a slam against the judge.
