The family of a 5-year old girl killed by a flagpole found that the case is closer to a trial by jury on September 28th. The Michigan Court of Appeals has refused to allow Ferndale Public Schools an appeal; the school had tried to argue that the flagpole was not part of the building.
The school’s claim that it hadn’t known the pole was defective was dismissed as well.
The flagpole, which was over 86 years old at the time, was steel and 44-feet tall when it toppled on April 16th, 2007. Angel Popcock-Smith was playing with friends when it struck her on the head, killing her.
