I watched a 45 minute interview on the TMZ website about Mel Gibson and the extortion investigation last night and that’s alot to ask for the web browsers.
However, it was so interesting, I just kept right on clicking each segment.
What is “extortion” in today’s world? The two attorneys, Harvey Levin and Daniel Horowitz quizzed each other?
That is exactly what I wanted to know and you can read my analysis on how an attorney like Gloria Allred makes a career out of squeezing money from celebrities caught red handed, while an average guy or gal gets called an extortionist and goes on trial.
You can read my other article on ” Extortion ” and Gloria Allred clients at my profile page.
What does the word ” Extortion” mean? According to wikipedia here’s the definition:
Extortion, out wresting, and/or exaction is a criminal offense which occurs when a person unlawfully obtains either money, property or services from a person(s), entity, or institution, through coercion. Refraining from doing harm is sometimes euphemistically called protection. Extortion is commonly practiced by organized crimegroups. The actual obtainment of money or property is not required to commit the offense. Making a threat of violence which refers to a requirement of a payment of money or property to halt future violence is sufficient to commit the offense. Exaction refers not only to extortion or the unlawful demanding and obtaining of something through force, but additionally, in its formal definition, means the infliction of something such as pain and suffering or making somebody endure something unpleasant.
In the United States, extortion may also be committed as a federal crime across a computer system, phone, by mail or in using any instrument of “interstate commerce”. Extortion requires that the individual sent the message “willingly” and “knowingly” as elements of the crime. The message only has to be sent (but does not have to reach the intended recipient) to commit the crime of extortion
Now you can see the definition of ” EXTORTION” is very vague. Just about anyone could be accused of extortion.
Is the legal burden different?
Why is the Russian ex girlfriend of Mel Gibson being investigated for it and will she be charged?
According to her attorney Daniel Horowitz Oksana will skate free despite the emails and letter she sent demanding money from Mel Gibson or she would publicly release tapes to embarrass and ” destroy” him professionally.
This certainly meets the legal definition.
However, Harvey Levin pressed her attorney to comment on the likelihood Oksana will have to speak on the record about the money she wanted in exchange for her silence and the notorious ” tapes” of his outbursts .
Will she take the 5Th? Harvey asked ( Meaning will she refuse to speak on the grounds she can get herself into legal hot water by trying to bully Mel into turning over cash for her tapes.)
” No, she will not. She will testify” Horowitz claimed while trying to skirt the question for ten minutes.
But Horowitz swears the investigation will not get that far.
Well, she shall see !
