According to CNN.com, Lindsay Lohan reportedly failed at least one court-ordered drug test this past Friday. The news comes less than a month after the sometime actress/magazine model was released from rehab as part of the terms stemming from her 2007 DUI conviction. If it turns out that she did in fact fail the drug test, she could be convicted of violating her probation, and could face 30 days in jail.
News of Lohan’s alleged stumble comes hot on the trail of reports of Paris Hilton’s guilty plea in her cocaine possession case. Hilton was arrested late last month in Las Vegas when the SUV driven by her boyfriend was stopped by police for suspicion of marijuana use. When Hilton was taken aside for questioning it was discovered that she had been holding a small amount of cocaine in her purse. Although she originally denied that the purse or the cocaine were hers, Hilton changed her tune in front of a Las Vegas judge today, admitting that she lied to the police, in exchange for a reduction of the charges from a felony to a misdemeanor offense. According to USA Today.com, the plea bargain allows Hilton to attend a substance abuse program, complete 200 hours of community service, and pay $2000 in fines in lieu of serving any jail time.
Upon reports that she had allegedly failed at least one of her most recent twice-weekly drug tests, Lohan’s probation has been temporarily revoked. That motion is being delayed, however, unless she fails to appear before the judge overseeing her case on Friday morning as directed. Given her legal history, her attorneys may well try a plea bargain like Hilton’s did in the hopes of keeping their client out of jail as well.
Like Hilton, Lohan has already served time and been sent to court-mandated rehab. Unlike Hilton, she has an extensive personal and legal history of substance abuse, not the relatively more haphazard mishaps that Hilton seems prone to. Lohan was due for the next hearing on her adherence to the terms of her probation November 1st, but if she violated them beforehand, Judge Fox had already previously indicated that she would almost certainly serve more time in prison if that happened. If it turns out that Lohan did fail one or more of her court-mandated drug tests, it may be impossible given her legal history for her attorneys to keep her out of prison this time around.
