A very interesting topic keeps coming up in all of these celebrity pay out cases such as Mel Gibson where rich people are approached by a person who threatens to go public with their misdeeds if a big payout is not delivered pronto.
Robert Halderman, was a screenwriter who attempted to do it in the high profile David Letterman “sexual harassment” scandal where Dave was accused of dating his female employees. The man went to jail for over a year. it destroyed his career and he apologized to Dave after being caught in a FBI sting to get a large check in exchange for his silence.
However, high profile Gloria Allred has been using this tactic for years. She is one of the most feared attorneys in Hollywood and her own daughter Lisa Bloom once commented on her ability to elicit multimillion dollar payouts from celebrities. When a reporter was trying to guess the total of the Tiger Woods payout, Bloom hinted that her mother will not settle for less than six figures.
When Gloria Allred went to Tiger Woods and claimed that his ex girlfriend Rachael Uchitel was going to spill the beans on their affair, the married Tiger Woods immediately paid her in the neighborhood of $ 10 million dollars not to speak out on his infidelity.
Isn’t that Extortion?
More recently, when Gloria Allred threatened ex- Ceo Mark Hurd with a story of possible sexual
harassment and wrongful termination by an ex contractor of Intel, was that not extortion?
Furthermore, if it involves a “crime” such as sexual harassment can be interpreted to mean, isn’t that also obstructing justice? I do not understand why the writer Halderman in the David Letterman case went to jail for a similar accusation that made Alred’s client a six figure settlement.
Where is the justice there? I guess ” extortion” is OK if you are the “injured” party or the person involved in the love triangle.
Daniel Horowitz, a lawyer talking on the record at the TMZ website with Harvey Levin stated that he is certain that his client Oksana Grigorieva will be cleared of extortion charges. Why? Because Horowitz claims that he has filed an extortion case which was dismissed in the past and that asking for money is not extortion.
Levin and Horowtiz mused on the subject of Gloria Allred who has made a career out of threatening news conferences and then canceling them after her client gets her payout not to go public with stories.
Recently, Gloris Allred finally got “called out” by the attorney for “Bones” actor David Boreanez after a highly publicized attempt to get money pretty much fell apart after the woman was revealed to be kind of a user cat .
Boreanez through his attorney called Gloria Allred’s attempt to collect more money for a woman who was an extra on the set of his show an attempt at ” EXTORTION”. They said it publicly as David just went public himself and told the story of how the ” victim” kept asking for more and more money from him after he gave her a payout to shut up.
This was the first time somebody stood up to Gloria Allred and called what looks like a spade, well, a spade.
So the question of when ” EXTORTION” meets the legal definition of extortion continues to be debated.
